Is There a Biodiversity Crisis Essay Most commonly, biodiversity is referred to as the differences in the forms of life inside an ecosystem. There are different definitions regarding to the scope and to whoever has defined the word biodiversity. The first definition which the most common definition of the word states that biodiversity is the variation of life at levels of biological organization. This definition simply states that biodiversity claims the general differences in the living organisms that exist in an ecosystem. The second definition characterizes biodiversity as an assessment of the overall health of an ecosystem. The health of an ecosystem is relatively based on the number of species that thrives in an ecosystem. Thus, biodiversity is also measure of the relative physical condition of the different organisms alive in an ecosystem. Another definition, which is most commonly used by ecologists, describes biodiversity as the entirety of the genes, species and ecosystems of a certain region. This third definition relates the three basic levels that identify biodiversity: (1) genetic diversity, (2) species diversity and, (3) ecosystem diversity. In the main, biodiversity for ecologists also relates the interactions of species to species and also the interaction of the species to the environment they are in. Therefore, it is not only the species of organism that are interacting with one another but also the organism are interacting with the air, soil, water and the factors that constitutes the totality of the environment. The environment is very essential to all the living forms in the planet. Clearly, it is the provider of our most basic needs: food, water and air. It gives us water for drinking, air for breathing, food to supply as with energy and other necessities. Humans are pat of a very big ecosystem ââ¬â the earth. With all the animals and the other forms of living things in the earth interacting with one another, surely, one kind of species needs the other in order to survive. Such as the way the spider needs its web and the horse needs the grass, all the organisms, need the planetââ¬â¢s wealth in order to survive. The collection of plants and animals are the ones that keep an ecosystem stable. The more diverse an ecosystem is, the more that it is stable and the more that it is likely to survive. Biodiversity crisis is one of the threats that lead to the extinction of certain species of animals and plants. Still, nobody knows the importance of each and every living thing on earth. However, their loss can be equated to a loss in medicine, technology and balance in nature, which in turn mar risk the lives of humans. Factors There are so many factors that contribute to the weakening and deterioration of biodiversity. It includes too much use and over exploitation, physical and chemical modification of the areas which serves as habitats for certain organism, introduction of foreign species of organisms to an area and modifications in the conditions of habitats. Some factors that contribute to the total fall of biodiversity in an area are also socially based. This includes rapid population growth, over exploitation of resources, useless and ineffective knowledge, unworthy management and increasing demand for areas to be modified into industrial and technological spots. Human activity is a large fraction of the causes of biodiversity crisis of the world. The diverse activities of humans can be accounted as the primary cause of the degradation of the diversity of life of the planet. Certain human activities create a huge impact to the environment. Two of which are human population and the level of consumption of humankind. These two factors constitutes to the major environmental changes that are happening in the planet. Also, the principal activities of humans for the purpose of his survival in the planet such as agriculture, fishing, hunting, manufacturing, trade, industry, and even recreational activities such as hiking, mountaineering and tours are directly and indirectly creating a major effect on the environmental balance. Records show that hunting and sever use and exploitation of the animal life and environment are the most cases that can be observed in the word today. These activities are the biggest threats to the existence of various kinds of animals not only in Tibet but also in other countries such as Thailand and Philippines. In Tibet, exploitation of animals is a major environmental problem. Animals are being killed for commercial reasons. Skin of rare animals, antlers of deer, heads of various animals mostly the Tibetan gazelle and fur of wild animals such as leopards can be seen in the market and are sold openly without penalties and forced restrictions by the authorities. More to that, hunters are not only free to kill animals in the wild but also, they can get their own permit to hunt in the wild. They are given permit to kill animals for the purpose of producing income and for the purpose of causing a rapid decrease in the population of the animals that they use for commercial purposes. Also, another major cause of biodiversity crisis in the world and still, an example of human activity is forest degradation and transformation of habitats to industrial sites. Forest degradation does not only concern the loss of trees in the rainforests but also the loss of the animals that depends on these trees for survival. Wide exploitation of the forests has been recorded in most of the countries in the world as early as human population began to rapidly increase. The act of cutting trees to be used either for construction of houses or for the purpose of selling to companies and other groups and for the purpose of having a new site wherein industries, houses, subdivisions and chemical plants are to be erected, all constitutes to the improper and over utilization of resources. These activities are the roots of extensive migration of birds and animals to other areas which causes over crowding of species in an area and wide losses in certain species that eventually dies due to the loss of trees and the loss of the existence of rainforests which serves as their habitat. Losses These human activities in effect, cause enormous impact to the environment. Effects incorporate land transformations, rapid decrease in the population of specie which mostly results to extinction and immense changes in the patterns of weather, water cycle, nutrient accumulation and chemical introduction. In the long run, these direct effects of human activities consequently are the ones that cause various changes in the global climate, patterns of migration, reproduction and habitat and an overall irreversible loss form the environment and consequently a loss to the humankind. On the whole, human activities have brought changes not only to the other living organism in the planet but also to the planet itself. Accordingly, human activities have caused the environment to weaken inducing a less stable planet that could less support existence of life. The world is rapidly loosing its wealth and richness. Due to the acts of man, not only he and the other forms of life are at risk but also the whole world. Manââ¬â¢s activities constitute much of the factors that contribute to this hasty decline. As man continues to increase its population and greedy concept of living, the diversity of life is steadily going to a point of fall. As this happens, lakes and rivers are transformed to highways and canals, forests will soon be out of trees and animals and will be turned to deserts. Natural diversity will be continuously raped and will make way for the rise of towering buildings, winding roads, infrastructures, houses, villages, factories, mines, schools, shopping malls and gardens. Existence of the technological advancements will soon interfere with the usual patterns of the weather and global climate as well as the lives of different species. In turn, they will be extinct and will never be enjoyed again by the coming generations. Eventually, the works of man today will weaken and continuously exploit the wealth of planet until comes to a point where it can no longer hold for the existence of man and his doings. As a result of globalization not only all the countries but also the companies in the world try to adjust with new technology as well as with the electronic systems such as information system. Nowadays businesses like to outsource their company activities rather than bind with same industries. But there is an out sourcing cost which has to be born when the tasks of the company are outsourced. There are so many advantages as well as so many disadvantages can be seen like secret information can be spread all over the industry by outsourcing of such systems such as salary systems, financial systems, HR systems, manufacturing systems in an organization. There are so many information systems are found in companies as payroll systems, accounting systems like AC pacc packages, Accounting spread sheets, Oracle, SAGE and so on. They are providing a value added advantage to the business by minimizing manual errors, frauds etc. But in outsourcing of manufacturing functions of an organization; core-competencies, improving in production as well as the quality must be considered before outsourcing. Inter organizational information system is an important tool to carry-out organizational activities more than above mentioned information systems. These kinds of systems are supporting to enhance telecommunication technology among the business units. It is a good sign for future markets. The inter-organizational systems are also built as result of e-business as well as globalization. Importance of the Study This kinds of system are very important in so many hands like, can share information as well as decision from top to bottom by using information systems. With the help of such systems organizations can address each and every kind of people not only the managerial people but also in normal employees such as clerks, peons and so-on. Information system actually plays a wide role in business world not only by providing information to the organization body but also by gathering facts, data, information from out -side which are useful to the company. Exchanging sharing ideas among the business units is very helpful to survive in the business world, hence inter-organizational business acts major role to fulfill such circumstances. As an example, if in such company divided in to business units as manufacturing unit, human resource unit, finance unit and so-on, this inter organizational information system is very much essential to make co-ordination among these units and achieve specific goals within a minimum time period. In present we can see so many accounting information packages as mentioned earlier to build inter-organization relationship between accounting divisions of same organization. Most recently, businesses like to out-source their functions with out-side companies who provide out-sourcing facilities; in such situations inter-organizational information system act as a connector of the main business as well as the out-sourcing units. This also can be used to get the competitive advantages by understanding the threats and opportunities. Inter organization information system is one of the system tools which helps to make efficient in business in modern world since most of the companies addicted to practice such systems more than earlier decades as a result of new technology. IOS dependencies and its significance Todays world is well known for the technical computer oriented world. Renewed organizations totally depend on the E-business (Electronic Business). E-Business proves a very good source for the advertising of product. E-Business is very good example of inventions and innovations as well as improved skills of technology of a company. So there can be seen a strong relationship between IT and Inter-organization system. An industry has many branches like firms but each industry has its own IT (Information Technology). Each company has a desire to spread its business in worldwide area such as multinational company. So there can be seen a desire to make profit, attract consumers, offer facilities to its own clients. There is a trend of international trade as well as strong relationship between an industry and outside partners. When a companys will is on global, then there will be major point of outsourcing. For the uprising of the industry and the whole firms of an industry tries to offer a high quality production to its customers, IT proves a major aspect for the advancement of the organization. When a company make a product then it has to spend a large time to see gain profit, improve quality, consumers, competitors, price, substitutes, demand, supply chain, stock, as well as internal and external suppliers. For example when an organization produces a product the major points will be demand for the product, price of the product and status of competitors among the industry, when demand increases for a product then automatically output and input of the product increases according to supply and price. Substitutes are also involving for the production of the product. Demand is flexible, so production is also flexible. A product is always built to order (BTO). It requires order, demand, outsource, employed etc. There can be seen long term demand as well as short term demand such as the demand for warm clothes increases in winter not in summers but on the other hand patrol is all ways needed. When the price of the product will decrease then demand will be increased. The effective policies permitted by law prove beneficial for the further development of the organization. Each organization concentrates on social, economic condition as well as cultural, policies, suppliers and buyers teach it how to manage in society. Inter-organization system is related with suppliers and buyers performance. Planning and decision making process is also related to supply chain management. Inter-organization is also related to market such as shareholders, stock, demand factor. To improve supply chain management there is a system of Quick Response System (QRS) in this way an organization can improve its relationship with suppliers/buyers and between two parties. Supply chain management can improves itself by offer a high quality of product as well as good quality of raw material. A high quality of the product will have ability to provide satisfaction of its customer. The three well known level of communication is micro, meso and macro. Micro related to individually, Meso related to group and Macro related to broader aspect communication. Senior management makes decisions for organization to make product, to gain profit as well as investment. RESEACRCH CONTRIBUTION I have analyzed the higher level of external co-operation shared towards advancement process efficiency where inter organizational systems allows firm to gain sourcing trust over their suppliers. Higher level of Information system may not be useful for gathering information from the market and compare with the different available options. Information system also provides the facts that the firm produces standardized and good facing cut throat competitors by process efficiency by working enhancement higher level of corporation. IOS allows the organization to achieve all the aim target process oriented suppliers and buyers. Mangers should be very careful to check the processes which are fulfilled by the employees on the base of IOS. It is controversial that using ISO and gives advantage for transactional needs. It can help organization in the use of electronic system to target market as well as valuable suppliers. Were as all the process can be achieved only when the electronic system is established through integrated system. Suggestions helps the managers to identify the different facts of inter organizational system and making a decision and implementation and the use of inter organizational systems in different sections, the findings done by various researchers in the field of knowing the impacts in relation to the adoption of the impact of Inter organizational system. By the process of planning to use the information system, organizations become dependent on each other and a mind-set of trust is increased among partners. For the development of cooperation between organizations, they need to assure that there is continuous flow of information between the cooperating partners. The main purpose of this system is to share data, information, business applications to make available the electronic transactions about buying and selling of goods and services for the business partners. IOIS is also familiar for its business name Electronic Data Interchange (EDI), as it is an easier and comfortable way of interchanging data for organizations. Moreover Internal Information system helps employees up to a great extent to save their precious time, as they can collect data for their work sitting at one place only and it can be very helpful for organization in terms of gaining more profit. Furthermore, Inter-organizational information system is a boon in field of business for all organizations, as it gives comfort to them to collect and interchange their data while communicating via internet only, by using this indispensable tool of IT, it gives golden opportunity to organizations to place electronic order for goods, confirming their collection time and share number of other documents instantly with their business partners world wid. In addition, reduction in cost of communication, labor and paper work are other inevitable benefits are given by IOIS.IOIS gives chance to firms to improve their relations with their business partners and supply chain as well, as lots of problems and conflicts can be sorted out with far-away places trading partners with the introduction of this system and which gives a mutual benefit in business. In contrast, as each prospect involves pros and cons. So IOIS has few negative features as well. First grey area of IOIS is its additional expenditure to Value Added Network (VAN) reaches up to $5000-$7000 per month (Bartholomew 1997). Consequently, adoption of this system is not that much easy specially for small companies because of its expenditure, so it can be unaffordable to bear its cost for small scale organizations. As well as, for a successful Implementation of IOIS, a compatible hardware is must at both the ends, for instance, on one hand, one company is having a compatible set up for IOIS, however it is not the same with its trading partner on the other side, so it is obvious to arise difficulties while communicating and data interchange, so undoubtedly these hurdles due to poor hardware will affect the business financially as well as the relations personally in future. Moreover, one major drawback of this system is, as it is an internet designed system. So business strategies and policies, scheduling goods of various firms are available online such as financial reports and so on, So gathering and misusing data that is just childs play for a person who has full command on computer operations and that thing can be damaging for companies, as their secrecy can be leaked and misused by any other organization for their own benefits. Not surprisingly, IOIS is not reliable enough in terms of Security, as authentic informations and companys unwanted plans can be revealed and altered or adopted easily by any other company, which can harm the company in a harsh way. We come to understand the concept and depth of inter organizational information systems in the merit to large and small enterprises, that information systems plays a main role in an organization for various processes and functions such as accounting, data transfer, emailing, recording data, secured transaction data and semi manual organized data. This type of functioning helps the organization to do its work and transacting of details to the computer and to the party with in a small period of time which makes the work of an organization even faster. Thus this even helps in building good relationship with buyers and sellers. This type of software is expensive most commonly termed as system to system. But various small companies or outlets need infor mation systems so semi automatic, system to human interface is provided thus this software is not expensive also and is effective for such data transfer. The term information system means handling or providing information about a particular subject from one party to another party in the mutual understanding between them. System to system and system to human integration has helped the buyers and sellers to resolve the problem of leaving back the barriers of electronic business but it is only partly resolution only if total efficient benefits are the aim. RESEARCH LIMITATIONS 1. Research limitations on organizations whose business processes carried on by inter organizational information system tasks are mainly outsourced. 2. When needed the concepts relating to practical narrow area can be applied. 3. The reliability and sustainability in IOIS is a bitter experience for various organizations due to its inflexible electronic intend. 4.For doing various research on organizations researchers are not free to get important documents from the firms due to its secrecy, this documents could help researchers to find out a way around to provide solutions for various problems relating to IOIS impacts on SMEs. RECOMMENDATION In todays world of computer oriented functioning it is possible for information systems to get hacked by various hackers who do this to destroy ones organization and to steal money. I recommend that security measures should be taken by providing such strong software that can avoid unauthorized entry in the information systems of an organization. Inter organizational information systems effective functions depends on the management of the organization to implement effective procedures to resolve the errors caused in the information system and to keep an eye on the employee of the information technology department for their delay or miss input of data for transactions from system to system, that would cause in heavy loss to the organization. The study on comparisons between the intensity of inters organizational information systems and the brunt on small medium enterprises is not done or found in various books and articles. To determine the study on brunt on small medium enterprises should be taken into consideration. I recommend that small and medium sized enterprises should be taken into consideration because they have been departed from the co operated networks provided by inter organizational information systems. Exploration of the Brain in Emily Dickinson's Poem 670 The brain is one of the most complex organs of the entire human body. How many people over the course of time have explored and tried to explain the brain? Even with millions of peoples' opinions of how the brain works, we still do not understand the most intrinsic parts of it. The tricky part is the subconscious. We are able to hide things, even from ourselves, for years. How is it that we can bury so much information that becomes so hard to find? Emily Dickinson understood this concept. She did not understand the way the brain works, perhaps, but without a doubt she did understand that it is able to conceal things from ourselves. "The brain has Corridors-surpassing Material place" (3-4). Surpassing all material things, the brain is past those things. Within the corridors are heaps of information that we sometimes even become unaware of. Something has to be a trigger, to set off a specific corridor in order to bring that information back to mind. Many times this is proven when a person whom has endured abuse as a child is counseled. Psychiatrists have to probe deep into those corridors to retrieve information that the child has willingly or subconsciously buried. So, why was Dickinson so interested in these corridors? Perhaps she was dealing with something of her past and during that time realized how hard it is to retrieve things sometimes. Perhaps she was counseling a close friend or family member and wrote this as a result of that. Perhaps she was studying the brain and became interested in doing research. Perhaps none of these things were the case with Dickinson. Whatever her reason, the poem shows much thought. We go on to read that any ghost meeting at midnight is safer than probing into that abyss called the mind. Why is it so unsafe? Well, what kind of things do we bury deep into our minds? Normally, they are things that we want to forget, painful memories, and embarrassing experiences. Those things can definitely be considered dangerous. If they were not dangerous, why would we bury them in the first place? To illustrate this point, I am going to tell you a story. I am the child of an alcoholic father. I have always lived under dangerous circumstances, and because of this, I have chosen to forget much of my childhood.

This usually requires the creation of statements of corporate responsibilities for each individual company. A father purchased a toy gun as a birthday gift for his young son. His son went outside to play and and encountered a police officer who shot him seven times. This incident occurred in Sonoma County in October 2013. A similar incident occurred in November 2014 when Cleveland police killed a 12-year-old boy carrying a toy gun. Use of excessive force by police is common in impoverished "black" or "brown" communities. The website, uslegal.com, defines police brutality as: Police brutality is a civil rights violation that occurs when a police officer acts with excessive force by using an amount of force with regards to a civilian that is more than necessary. Excessive force by law enforcement officers is a violation of a person's rights. Excessive force is not subject to a precise definition, but it is generally beyond the force a reasonable and prudent law enforcement officer would use under the circumstances (ââ¬Å"Police Brutality Law & Legal Definitionâ⬠,2013). Cases of brutality from people, who are supposed to protect against it, have existed even when the United States was a fairly new country. The oppression by people in power, even the U.S. Constitution excludes ââ¬Å"Illegal personsâ⬠as three fifths of a person, which includes slaves, immigrants, and Native Americans. Another example of oppression by individuals in power would be during the Indian Removal Act of 1830, millions of native peoples were removed from lands that they had been living on and cultivating for generations. Although many tribes had tried to fight this removal, the Cherokee tribe had fought this act through the court system, which had granted them to stay on their land. 759 Store is one of the famous supermarkets in Hong Kong. Many people love to buy 759 Storeââ¬â¢ products because of the lowest prices. Their marketing strategy is ââ¬Å"small profits, quick returnsâ⬠which mean they sell their products at low price in order to increase the stock turnover rate and earn the profit faster. However, some research shows that the price of the local products in 759 Store are much lower than others competitors and some of other retailer shop owners pointed that 759 Store are underpricing their products intentionally in order to eliminate other competitors.Since 759 Storeââ¬â¢ strategy is ââ¬Å"small profits, quick returnsâ⬠, their productsââ¬â¢ price have to be lower than the same products in outside market in order to earn profits form each products. This strategy provides a quick return on stocks and rapid cash inflow to 759 Store.Since 759 Store want to extend their market share, they have intention to do the predatory pricing which means to reduce other competitors profits by underpricing, when others competitors can not afford their operating cost and shut down, the price will rise back to original level and the shop can monopolize the whole market. Some research shows that 759 Storeââ¬â¢ sales can barely cover the costs of their products which indicate that some of their productsââ¬â¢ price are even lower than the cost. The owner of 759 Store has decided to expand his business in order to earn larger market share. Although underp ricing will not violate the law, is it ethical to do so? According to AMA code of ethics in marketing, practicing predatory pricing is unethical. It is an anti-competitive measure to protect market share from new or existing competitors which involves temporarily pricing a product low enough to end a competitive threat. 59 Store should have ensured the fairness of their business and donââ¬â¢t engage in predatory pricing. Also AMA code of ethics have mention the openness of a business which means to create transparency in marketing operations. Many owners of small business have contracted 759 Store about their problematic pricing strategy, but 759 Store still insist in selling their products with low prices. This indicate that 759 Store is lack of communication with others and do not accept the criticism form others. According to 4Ps marketing model, the only ethical issue of 759 Store is pricing. 59 Store represents ethically on other 3Ps. For example, they ensure their products are safe, their products and packages have least impacts on the environment. Also, they do not have any deceptive or misleading advertising or bribery in promotion and there are no gray marketing exist. To improve, 759 Store should deal with their pricing problem. First of all, they should stop practicing predatory pricing and the major reason of them to do so is supplier specifically selling their products to 759 Store at low price.Since 759 Store have many branch in Hong Kong, they can perform bulk purchases to the suppliers and ask for the discounts which is impossible for others small retailers to do so. Therefore, I suggest that suppliers should have fixed price to sell their products to all retailers and do not offer any discounts. Any other method the stop the problem is that 759 Store stop selling local products and focus on selling Japanese products since most of the customers are buying Japanese products form 759 Store and it can avoid affecting other competitor because th e problematic pricing is occurred on local products only.If 759 Store can focus on selling Japanese products, they probably can gain larger amount of profits because price of Japanese Yen are declining currently which leads to a lower price of imported Japanese goods. Gender /Sex Discrimination in the Work Place Essay
Thirty five years after civil rights act of 1964 was passed, female workers amounting to 80% are still doing the ââ¬Ëwomen work. ââ¬â¢ Some as secretaries, others are sales clerks while others are support workers in the administrations. In the year 1993, only 19 women found themselves among the directors in the country and more than 500 boards had no female members. In 1999, the New York Times conducted a poll and found out that the biggest problem women were facing in America at that time was job discrimination. In the same year, working women were so much concerned about the wage gap between them and their male counterparts. Although the law came to prohibit these discriminations they continued even after (Mayor, 2010). This essay seeks to find out what the law is all about and who are covered in the law. It also seeks to differentiate between sexual and gender identity discriminations and sexual harassment based on some case studies. The federal law title VII, criminalizes any harassment or discrimination in the work place. It encompasses or covers all the employers in the private sector, state and local governments including education institutions which employ 15 workers and above (HR Hero, nd). Other groups that are covered by the law include; government agencies, political sub divisions, labor unions, associations, corporations, companies among others (US Equal Opportunity Commission, nd). The term employee as used in the act refers to a person who is involved in industrial activities that affect the commerce of the county and has more than 15 workers under him. It also refers to corporations that belong to the government or the Indian tribes and any department in the District of Columbia. The word also includes clubs that have private membership which do not pay tax as provided by the law. The term employment agency as used in the act refers to those persons who are involved in searching for employees on behalf of the employers either with or without compensation. Another group that is covered in the law is the labor organization. This refers to all those labor organizations which are affecting commerce in one way or another. This may also include the agents of these labor organizations and also committees that represent employees. Those groups which are involved or deal with grievances of the workers are also covered in the law (US Equal Opportunity Commission, nd). Apart from prohibiting discrimination in the work place based on sex, race, color, religion basis and national origin, it goes further to prohibit discriminations based on pregnancies, sexual stereotypes and sexual harassment against the employees. Currently, the law does not include discriminations based on sexual orientations but under the employment non ââ¬âdiscrimination act, that kind of discrimination is covered. Many states have implemented this law and they have included more classes to be covered for example, marital status (HR Hero, nd). Civil rights act of 1964 has so many provisions in regards to employers and employees in the work place. Under section 2000e-2, the law declares that, it is unlawful for the employer to discriminate against any individual in regards to terms of payment, compensation package or privileges that the employment offers based on his /her race, gender, country of origin, color and religion. The law continues to say that any employer, who will be found imposing limitations to his workers, preventing them from accessing employment opportunities based on the above mentioned discrimination grounds, will be criminalized (Find US Law, 2008). Both employment agencies and labor organizations have also been put on notice by the law in that, when they fail to employ a person based on race, sex color among other factors, then they will also face the law. The term ââ¬Ëbased on sexââ¬â¢ here, refers to, based on pregnancy or medical conditions that are related to it and child birth. In the act, the law requires that all women affected by the above mentioned conditions, should be treated equally just like their male counter parts in regards to work related issues. This also applies to the benefits that they are supposed to be given. The condition that they are in should not limit them to enjoy their benefits just like other workers who are not in their condition. These provisions are included in section 2000e-2(h). This section does not allow the employer to pay for abortion benefits unless the life of the mother is in danger (US Equal Opportunity Commission, nd). Moreover, under this section it is considered unlawful when an employer comes up with standards of compensation or privileges and earning measuring system with an intention of discriminating employees based on the earlier mentioned factors. They are also forbidden to come up with ability tests whose results are intended to discriminate individuals. An employer is also not supposed to be biased when it comes to determining the amount of money he is going to pay his workers especially when based on sex. This can only be allowed when it has been provided for in the section 206(d) of the labor standard act of 1938, title 29 as amended (US Equal Opportunity Commission, nd). This law makes the employers responsible to prevent sexual harassment cases among their employees. They are supposed to take caution in regards to sexual harassment and correct any instance of it in the work place (Equal Rights Advocates, 2010). Differences between sexual discrimination, sexual harassment and gender identity discrimination Sexual Discrimination Sexual discrimination is mostly associated with the employers but if can also be committed by other employees. When this happens, the employer would be held responsible. There are two types of sexual discrimination; direct and indirect. The former refers to those situations where women at work place are treated with less favor than their male counter parts because of either their gender or marital status. Direct discrimination also comes in when treating a woman less favorably because she is pregnant or has gone for a maternity leave and this can extend even to pregnancy related illnesses. This mostly happens for example when a woman has gone for an interview and the interviewer only concentrates on the domestic circumstances of the interviewee (Thomsonââ¬â¢s Solicitors, 2010). Another instance of discrimination based on gender comes in when a man who is less qualified than a woman is employed instead of her or when a man who is less experienced in the work place is promoted. Sometimes they are given excuses that those jobs are dirty ones and that there are no good toilet facilities for them. Sometimes, employers can be so cruel to the extent that, they can demote a woman because of her pregnancy or just immediately after maternity leave. In addition, sex discrimination comes in when a woman employee is not allowed to see clients or meet them for that matter and sometimes she cannot be invited to social events and instead a male colleague is chosen over her (Thomsonââ¬â¢s Solicitors, 2010). Indirect discrimination refers to the adoption of some policies or practices in the places of work by employers. These policies are in one way or another disadvantageous to one gender than the other, even though they may appear on the surface to treat them equally. For example, an employer may require his employees to work full time and this disadvantages most women by barring them to take such a job. Some examples of this kind of discrimination include; some employers imposing age bars to their workers which can affect women negatively because most of them take time out to go to bring up children and thus these age bars will mean that, they will acquire their qualifications later than men (Thomsonââ¬â¢s Solicitors, 2010). Some employers may also give their workers some benefits as a result of working for long in an institution and this will definitely not favor women who have decided to take time out to go and bring up children. Clauses related to mobility are also out to work against women in that, they may have difficulties when it comes to relocation because of their families and sometimes because of relying on their husbands as primary earners in the house. Some employers also go to the extent of requiring their workers to provide weight and height measurements and this will favor male workers more than their female counter parts. Lastly, those employers who require their employees to work in those hours which are unsocial may disadvantage women who have family commitments especially those who have children to care for (Thomsonââ¬â¢s Solicitors, 2010). A case study related to this kind of discrimination involves a woman who had worked for a water transport business for some time but in her case, she was working in an office. Later, she decided to apply for a job in the same company but as a deck hand. In the process of application, she expressed her desire to acquire a captainââ¬â¢s license. She later complained that her male colleagues made her feel not welcome because they started to make such comments like how the job would be too dirty and heavy for her (Anti-Discrimination Commission, 2004). A time came when the business was facing some financial crisis and the company decided to do away with a particular service and this led to work hours for deck ââ¬âhands to be reduced. As a result, the company shortened her water ââ¬âtime and this made her lose hours and opportunities in training and career. Her complaints to the company over the issue on how male counter parts were being favored in regards to time were futile. She sued them and as a result, she won the case and a compensation of $12,000. The companyââ¬â¢s administration was directed to carry out anti-discrimination training among its workers (Anti-Discrimination Commission, 2004). This case study applies to discrimination among the workers themselves. Some companies also discriminate when it comes to offering services. In a case study, a woman wanted to be served by a certain company and in the process, she sought an appointment with the management for an in-home quote. The companyââ¬â¢s representatives told her that it would be better if her husband was present for the quote. In her astonishment, she asked if the same procedures would apply on both of them regardless of who was present but they ignored her. The company gave some excuses regarding the matter stating that singles or widows were allowed to be accompanied by friends. The company was directed by a court to provide written apology to her and also to develop an anti-discrimination policy in the work place (Anti-Discrimination Commission, 2004). Sexual harassment When it comes to sexual harassment, it is perceived as a form of sexual discrimination. It can be defined legally as any unwelcome behavior or conduct that is of sexual nature and can be expressed through the word of mouth, physical means or even through the eyes; the conduct having severe consequences affecting the working environment in a negative way, making it be hostile. This means that any conduct that is welcome is not sexual harassment. Sexual harassment can be committed verbally or written by commenting on how somebody has dressed, on his or her behavior, somebodyââ¬â¢s body structure, making jokes that are based on sex, asking somebody for sexual favors or for outings repeatedly. This may also include threatening a person or even spreading rumors about a personââ¬â¢s sexual life and also sexual innuendos (Equal Rights Advocates, 2010). Physical sexual harassment includes; assaulting a person, trying to block somebodyââ¬â¢s movement, touching somebody inappropriately which may include kissing, patting, stroking and even hugging. One can harass an individual non- verbally by looking at a personââ¬â¢s body from up downwards, using derogative gestures towards a person, or even employing facial expressions that are of sexual nature (Equal Rights Advocates, 2010). Following a person comes under non -verbal sexual harassment. Visually, it can happen through drawings, pictures, emails, screen savers and posters that are of sexual nature. Some people may be harassed because they are females not males or the vice versa. This can also be considered as sexual harassment of non- sexual conduct. For example, if a lady carpenter works among male colleagues and she always finds her tools hidden, this can be considered a sexual harassment. The only condition that must exist for a conduct to be considered a sexual harassment is when the conduct is severe or pervasive (Equal Rights Advocates, 2010). If one is fired, demoted or the employer refuses to promote one because of rejecting sexual advances, that is automatically becomes sexual harassment. Even if it may not lead to injury or job status changing, so long as it interferes with ones performance at work place or even creating a hostile environment; that can be considered as a sexual harassment (Equal Rights Advocates, 2010). A case referred to as Meritor Savings Bank V. Vinson is one of the best cases on sexual harassment. The Supreme Court held that if a relationship is not welcome, it is considered to be ââ¬Ëinvoluntary. ââ¬â¢ A plaintiff who was a lady sued her supervisor. During her first year working in the bank, she entered a relationship with him unwillingly because she feared losing her job (TWC Home, nd). She knew that she would face it rough the moment she refuses the advances. So she continued with the relationship for two years. The man would fondle her in the sight of other workers, sometimes follow her to the rest room and even go to the extent of exposing himself to her. For her, she did not expose his conduct to the management due to insecurity. The plaintiff proved that the relationship was unwelcome and it created a working environment which was abusive. The Supreme Court heard this and ruled in favor of her. The accused had to pay for the damages to the plaintiff (TWC Home, nd). Gender Identity Discrimination Gender identity refers to a situation of self identification either as a female or a male regardless of the anatomical sex at the time of birth. In normal circumstances, gender identity goes hand in hand with anatomical sex. A person identifies with females because she has physical features of females and a male does the same because he has male physical features. However, this does not apply to all human beings because for some, their identity does not match with their physical feature and this applies mostly to transsexual people (Work Place Fairness, 2009). A female may have the stronger side of males and a male may have stronger characteristics of females. Society may view the situation very differently. For example a man who identifies himself as a woman can be said to be feminine and a woman who identifies herself as a male is considered masculine. ââ¬ËTransgenderââ¬â¢ is used to refer to a person whose stereotypes of gender identity do not apply. This term refers to cross dressers; both male and female, impersonators from both genders, individuals who are inter sexed, transsexuals, males who are feminine and females who are considered masculine (Work Place Fairness, 2009). These people usually face a lot of discrimination especially at work place. Mostly, they are usually fired the moment the management learns of their plans to undergo surgery on sexual reassignment. Some of them live in fear of being fired especially those who engage in cross dressing outside their work places. Those who try to wear appropriate clothes that match their gender identity are usually punished or fired all together for not conforming to the companyââ¬â¢s policy of dress code. This happens especially in those companies that do not recognize individuals who are trans-gendered. Some employers even go to an extent of prohibiting these trans-gendered people to visit the rest rooms and are sometimes harassed by co workers on that basis (Work Place Fairness, 2009). This discrimination is not prohibited by the law particularly the federal one. How ever, efforts are being made to pass a law that will make this kind of discrimination illegal. Some have argued that, it can be covered with the law that bans all kinds of discrimination in the work place. Supreme Court has allowed these discrimination cases to be treated as harassment but is not clear how a court should handle such a case (Work place fairness, 2009). In conclusion, many people do not differentiate between the three kinds of discrimination making it hard to press charges regarding the matter. Some may have been discriminated without their knowledge and thus it is high time, companies adopt anti discrimination policies to make every one aware of his or her rights at the work place.
